Mistral AI updated its Commercial Terms effective 12 March 2026 to allow training its models on conversations from free-plan and Le Chat Vibe users by default — a policy now surfacing as a viral Hacker News discussion with 409 points, as business teams discover the change months after it took effect.

Which Mistral Plans Use Your Data for Training

The data policy varies by access method, not by topic or content type. The breakdown, per Mistral’s official help documentation:

    • Free plan and Le Chat Vibe: conversations used for training by default. Opt-out is available in account settings.
    • Le Chat Pro, Team, and Enterprise: data NOT used for training by default. No action required.
    • API (La Plateforme): data NOT used for training by default. “Data sent through the API isn’t used for model training,” Mistral states in its help center.
    • Labs Models (experimental): data used for training by default. No opt-out is available for this tier.

The risk for business teams is specific: teams that adopted Le Chat as a convenient front-end while assuming it carried API-level privacy protections are opted into training by default. Le Chat Pro and paid tiers are not affected.

How to Opt Out of Mistral Data Training

Mistral provides 2 opt-out paths, depending on which surface the team uses.

Admin Console (web and desktop): Navigate to Admin Console → find the toggle labeled “Allow your interactions to be used to train our models” → set it to OFF. This applies to the entire organization account when an admin disables it.

Mobile app: Go to Data & Account Controls → uncheck “Enable data sharing.”

Teams using Le Chat under a free plan should treat this as an immediate admin task. The opt-out is not retroactive to data submitted before the setting is changed.

How Other AI Providers Handle Business Data

Mistral’s policy follows the same pattern as every major AI provider: API usage is safe for business data; free consumer front-ends share data for training by default unless users opt out.

MistralTrains by default (opt-out available)Not usedLabs Models: trains, no opt-out

AnthropicTrains by default (opt-out available)Not usedClaude.ai free users opted in by default
GoogleTrains by default (opt-out available)Not usedGemini app free users opted in by default

For business teams evaluating the best AI tools for business, the practical rule is consistent across all 4 providers: never route sensitive business data through a free consumer interface without first reviewing that provider’s data policy and completing the opt-out.

    Our Take

The Mistral story is less about Mistral specifically and more about the pattern it confirms: all major AI providers follow the same data model, and most business teams never review it. The HN virality here is a signal that many teams adopted AI front-ends — Le Chat, ChatGPT, Claude.ai — before their IT or legal teams could set policy. This story is a forcing function to audit every free-tier AI tool currently in active use across your organization and verify opt-out status before the next employee submits a sensitive document to a free chat interface.
